1. Agreement to these Terms

These Terms and Conditions (“Terms”) are a legal agreement between you and Cruz Co Services Inc., a Georgia corporation (“Cruz Co”, “we” or “us”). They apply when you download, install, access or use the Cruz Co platform through our website at cruzcoservices.com or any of our apps or APIs (together, the “Platform”), whether you receive Delivery Services or perform them.

By using the Platform in any way, you agree to these Terms, including the Driver Agreement and Sender Agreement, which are part of these Terms. We may update these Terms at any time by posting a new version on our website and in our apps. Using the Platform after an update means you accept the updated Terms.

You may only access the Platform through our website, our apps or other means we authorize. You are responsible for downloading the correct app for your device, and we may deactivate accounts that use an incorrect or unauthorized version or device.

2. How the Platform works

Our Platform connects individuals and businesses who want items picked up, carried and delivered (“Senders”) with individuals and businesses who want to perform those deliveries (“Drivers”, also called Cruzers). Each delivery, including the items and the time it is performed in, is called a “Gig”. Senders and Drivers are both “Users”.

Drivers are self-employed independent contractors. Cruz Co does not control whether or when a Sender posts a Gig or whether a Driver offers to perform it, and Drivers may work on other platforms at the same time.

CRUZ CO SERVICES IS A LOGISTICS MANAGEMENT PLATFORM AND DOES NOT PROVIDE TRANSPORTATION SERVICES. WE ARE NOT A TRANSPORTATION CARRIER. IT IS THE DRIVER’S SOLE DECISION WHETHER TO OFFER FOR AND PROVIDE THE DELIVERY SERVICES REQUESTED BY A SENDER.

Cruz Co is not responsible for the performance, actions or inactions of any User, online or offline.

3. Eligibility and your account

Each time you use the Platform, you confirm that:

  • You are legally able to enter into these Terms and are at least 18 years old, or older if your state requires it.
  • You use the Platform only for your own use and will not resell it.
  • You will create only one account, keep your login details confidential, and provide proof of identity when we reasonably ask.
  • You will not impersonate anyone or misrepresent yourself. Drivers must use a true facial photo in their profile.
  • You will not present yourself as an agent, employee or representative of Cruz Co.
  • You will use the Platform only for lawful purposes and never to ship unlawful material, commit fraud or promote illegal activity.
  • You will keep other people’s confidential, personal and health information private and use it only to complete a Gig.
  • You will not collect information about other Users, or contact them outside the Platform or after a Gig is complete.
  • You will not stalk, threaten or harass anyone, copy our content without written permission, interfere with others’ use of the Platform, or infringe anyone’s rights.

All contact between Users must end when the Gig is complete. Tell us right away if another User contacts you for any reason other than your Gig.

4. Community standards

Non-discrimination. Cruz Co prohibits discrimination against any User or third party based on race, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other characteristic protected by law. This includes refusing or cancelling Gigs to avoid a neighborhood or person because of these characteristics.

Respect others. Users must never act in an aggressive, intimidating, threatening or harassing way. This includes hurting or threatening any person or animal, disrespectful language or gestures, sexual assault, harassment or misconduct of any kind, and disrespecting personal space or privacy.

Any User found to have violated these policies will immediately lose all access to the Platform.

5. Background checks and verification

All Drivers must pass a background check performed by a third-party consumer reporting agency before performing Gigs. During registration you must provide a valid driver’s license, your Social Security Number and written consent. With your consent, checks may also be run at later times as allowed by law. The check includes a criminal background check and a Motor Vehicle Record (MVR) report. It does not include a credit check.

To help prevent theft and fraud, Drivers may be asked for additional identity verification, such as a selfie or a scan of a driver’s license or other government ID. See our Privacy Policy for how this information is used and protected.

We do not currently screen Senders but may begin doing so. Screening is never a substitute for your own good judgment.

ALL USERS ACKNOWLEDGE THAT BY USING THE PLATFORM THEY MAY BE EXPOSED TO UNKNOWN THIRD PARTIES AND GIG CONTENTS THAT MAY BE DANGEROUS, OFFENSIVE, HARMFUL OR OBJECTIONABLE.

6. Driver responsibilities

Drivers must know and follow all federal, state and local laws that apply to each Gig, including rules on transporting items between states, restricted items and age limits.

Permits and insurance

  • Drivers act as their own employer. Cruz Co does not provide or pay for permits, licenses or insurance.
  • Drivers must carry auto insurance at least at the minimum required by their state, cover Gig activity, carry proof while driving and provide it on request. Personal auto policies may not cover delivery work.
  • Cruz Co does not provide health insurance or workers’ compensation unless required by state law. Drivers must have adequate health insurance and are responsible for their own medical costs.

A DRIVER MUST HAVE THE REQUIRED INSURANCE, LICENSES AND PERMITS TO CARRY ALL ITEMS CONTAINED IN A GIG.

Driver teams and personnel

Drivers may work in teams or engage helpers only if every person is registered on the Platform, passes a background check and accepts the Driver Agreement. Team members are jointly responsible, and a Driver is solely responsible for directing and paying anyone they engage.

7. Confidential information

While performing Gigs, Drivers may see confidential information about Cruz Co, Senders and recipients, including personally identifiable information (PII) and protected health information (PHI) under HIPAA.

  • Drivers may use or disclose PII only as needed to complete a Gig.
  • Drivers delivering prescriptions, medicines or medical documents must protect PHI and follow all applicable laws, including HIPAA rules for business associates.

YOU HAVE A STRICT DUTY TO KEEP ALL SUCH INFORMATION CONFIDENTIAL AND MAY NOT DISCLOSE OR USE IT FOR ANY PURPOSE OTHER THAN RECEIVING OR PERFORMING DELIVERY SERVICES. Failure to do so will result in permanent removal from the Platform.

8. Special items

Senders must clearly describe the items in each Gig so Drivers know whether they are qualified to carry it. Drivers who find an item that was not properly described must notify us right away at admin@cruzcoservices.com.

  • Alcohol and tobacco. Drivers must be 21 or older, check valid government ID showing the recipient is 21 or older, and not deliver alcohol to anyone visibly intoxicated. If delivery cannot be completed, contact admin@cruzcoservices.com.
  • Prescriptions and pharmacy items. Drivers must be 21 or older, travel alone, keep patient names and addresses out of photos, never leave the Gig unattended and hand-deliver it with a signature.
  • Live animals. Animals must ride inside a climate-controlled vehicle, never in a trunk or truck bed, with food, water and breaks as needed.
  • Bulky or heavy items. Drivers may offer on these Gigs only if they have the right vehicle, equipment and physical ability. Cruz Co is not liable for injuries.

9. Inspecting Gig contents

Drivers have the right to, and must, inspect Gig contents before leaving the pickup location and should photograph any damage and send it to admin@cruzcoservices.com. For sealed new-in-box items and baggage, Drivers inspect the outside packaging only.

A Driver is never required to take an item they have not been allowed to inspect and may cancel the Gig without penalty.

IF A DRIVER DOES NOT NOTE DAMAGE AT PICKUP, IT WILL BE ASSUMED THE DAMAGE OCCURRED WHILE IN THE DRIVER’S POSSESSION AND THE DRIVER WILL BE LIABLE FOR IT.

10. Sender responsibilities and packaging

Senders must follow all laws that apply to the items they send, including interstate rules, quantity limits and age restrictions, and are fully responsible for any failure to do so.

  • Open box policy. We encourage minimal packaging left open so the Driver can see what they are carrying. A Driver may always ask to inspect the contents before leaving.
  • Proper packing. Senders must pack items to withstand transport based on their fragility and risk. Cruz Co is not liable for loss or damage to items that are not properly packed, and inadequate packing voids Protection Plan coverage.
  • Live animals must travel in a secure, ventilated cage or box suitable for the animal, with food, water and bowls provided by the Sender unless otherwise arranged.

11. Prohibited items

Senders may not include, and Drivers may not knowingly carry, any of the following:

  • People.
  • Anything illegal, including recreational drugs and other contraband.
  • Hazardous waste, and hazardous materials not packaged and labeled as limited or excepted quantities under 49 C.F.R.
  • Unset precious stones, industrial diamonds, and items that are more than 50% gold or platinum by weight in raw form, such as bullion, bars or scrap.
  • Oversized items weighing more than 400 lbs or longer than 12 feet in any dimension.
  • Special items such as alcohol, tobacco, firearms and ammunition, fireworks, replica weapons, prescription drugs, human or cremated remains and live animals, unless the Sender has written permission from Cruz Co and follows all related rules.
  • Items to be transported across state lines.

Cruz Co is not responsible for prohibited or undisclosed special items and may dispose of prohibited items or deliver them to the proper authorities.

12. Cruz Co Protection Plan

Basic coverage. The Protection Plan reimburses a Sender’s actual cost to repair or replace items lost, damaged or stolen during a Gig because of a Driver’s negligence or willful misconduct, up to $100 per Gig, no matter how many items are included.

Additional Protection. Senders can buy Additional Protection for higher-value Gigs when booking. It cannot be added after the Gig is assigned. Coverage is limited to the amount purchased and to proven actual repair or replacement cost.

Qualifying for coverage. Senders must declare the value of all items, photograph them when booking, pack them properly and cooperate fully with any investigation, including providing proof of value, packaging and, for unexplained losses, a police report.

Limits for certain items

  • Checks: cost of stopping and reissuing only, up to $100.
  • Cash, coins, stamps, money orders and negotiable instruments: no reimbursement.
  • Gift cards, tickets and similar items: cost of replacing the physical item only, up to $100.
  • Live animals: no reimbursement.
  • Perishables: up to $100, only if properly packed and the Driver missed the requested time.
  • Documents, film and photos: replacement cost of the media only.
  • Heirlooms and antiques: proven monetary value only, with no reimbursement for sentimental value.
  • New-in-box electronics: only with visible, documented packaging damage. Used electronics: no reimbursement.
  • Prohibited and undisclosed special items: no reimbursement.

Couriers and other third-party logistics providers using the Platform to deliver items they were hired to deliver are not covered.

UNLESS YOU PURCHASE ADDITIONAL PROTECTION, CRUZ CO’S MAXIMUM REIMBURSEMENT FOR LOSS OR DAMAGE TO ANY OR ALL ITEMS IN A GIG IS $100.

13. Filing a claim

Senders must file a claim within three business days after the Gig is delivered. To file:

  • Collect proof of value and photos of the items.
  • Keep any damaged items and their packaging. If we pay for a replacement, we may collect the damaged item.
  • Complete the claim form and email it with your documents to admin@cruzcoservices.com.

We may reimburse the lowest price paid, the replacement cost at the time of loss, or the repair cost supported by a qualified third-party quote. For sets or multi-part items, we cover only the part lost or damaged. We may use a third-party provider to manage claims.

14. Cancellations and no-shows

Please cancel as soon as possible by tapping Cancel on the Gig Details screen in the app or calling Customer Support.

  • A Sender is charged a $10 fee for cancelling after a Driver is on the way, or for a no-show: arriving more than 15 minutes late without contacting the Driver, or more than 30 minutes late in any case.
  • No fee applies if the Sender cancels because of a Driver no-show or cancellation, or because the Driver cannot be reached.
  • Drivers who need to cancel should do so as early as possible so another Driver can accept the Gig.

15. Account locks, deactivation and appeals

We may temporarily lock or permanently deactivate an account, with or without notice, if a User breaches or is suspected of breaching these Terms, provides information we cannot verify, creates risk of loss or liability, is suspected of fraudulent, illegal or harmful activity, or includes prohibited items in a Gig. Other reasons include:

  • A second cancellation or no-show may lead to a temporary lock, and a third to deactivation.
  • A Driver rating below 4 stars.
  • Protection Plan claims under investigation, being found liable for a claim, or two or more claims.
  • Two or more shortages or unexplained disappearances of items.
  • No offers on Gigs for 60 days or more.

Most deactivation decisions can be appealed once by following the instructions in your deactivation email. Zero-tolerance violations such as fraud, theft, reckless driving, harassment or physical or sexual misconduct cannot be appealed. Appeal decisions are final. Questions about appeals can be sent to admin@cruzcoservices.com.

16. Billing and payments

Cruz Co is not a party to the agreement between a Sender and a Driver. All Users must provide payment or bank details. Payments are processed by Stripe under the Stripe Connected Account Agreement and Stripe Services Agreement, which you agree to by using the Platform. We may change payment providers.

  • Invoices. Each Gig invoice may include the Gig price, approved tolls and parking, cancellation, no-show or wait fees, and any Platform fees. Platform fees are due immediately and are non-refundable.
  • Payment release. Drivers are paid after completing the Gig as agreed. We may hold a payment while we investigate a claim, a prohibited item, fraud or other suspected breach.
  • Express Pay. Drivers may choose faster payouts for a disclosed fee. Settlement times are not guaranteed.
  • Tolls and parking. Reimbursed only when the Sender agreed and the Driver submits receipts within 15 days.
  • Taxes. Users are responsible for taxes on their use of the Platform and their earnings.

17. Text messages

By signing up, you agree to receive SMS messages needed to use the Platform and perform or receive Delivery Services. Message and data rates may apply. Changing mobile carriers may interrupt messages, and we may stop SMS services at any time. See our Privacy Policy for how to opt out.

18. Disclaimers and limitation of liability

The Platform and Delivery Services are provided “as is” without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Platform will be uninterrupted, error-free or secure, or that any User will be timely, reliable or properly licensed or insured.

Cruz Co is not responsible for the conduct of any User and you release Cruz Co, its officers, directors, employees, agents and affiliates from liability arising from your use of the Platform or your dealings with other Users. Cruz Co is not liable for indirect, incidental, consequential, punitive, special or exemplary damages.

IF CRUZ CO IS FOUND LIABLE, ITS TOTAL LIABILITY WILL NOT EXCEED THE TOTAL FEES PAID BY YOU OR TO YOU DURING THE SIX MONTHS BEFORE THE CLAIM AROSE. Some states do not allow certain limitations, so they may not apply to you.

19. Intellectual property and app license

Cruz Co owns all rights in the Platform and apps. We grant you a limited, personal, non-transferable, revocable license to use the apps on devices you own or control, following app store usage rules. You may not resell, copy, modify, reverse engineer, frame or mirror the Platform, use bots or scripts that burden it, try to gain unauthorized access, or use it to send spam or unlawful material.

If you post content on the Platform, you grant Cruz Co a worldwide, perpetual, royalty-free license to use it, and you confirm you have the right to do so. To report copyright infringement, send the details required by law to our Copyright Agent at admin@cruzcoservices.com.

  • Export control. You must follow U.S. export laws and confirm you are not in an embargoed country or on a restricted-party list.
  • Relationship. No partnership, joint venture, employment or agency relationship exists between you, other Users and Cruz Co.
  • Severability and waiver. If any part of these Terms is unenforceable, it will be revised as little as needed and the rest stays in effect. Our failure to enforce a provision is not a waiver.
